Terms and Conditions (Sample Only)

You as seller(s) agree to appoint Agent Hitchin Ltd, trading as Stonegate Estates to sell your property on the following terms:

  1. You agree to place your property for sale at an asking or guide price of  £ (TO BE CONFIRMED)
  2. Stonegate Estates will be appointed as SOLE agents on a sole selling rights basis from the date of this agreement for a minimum of  (TO BE CONFIRMED).  Once the agreed period has transpired either you or we can bring the agreement to an end by giving at least 14 days written notice and you will not appoint another agent to sell your property until such time as the agreement is brought to an end.
  3. You agree to pay our fees of  £(TO BE CONFIRMED)  or (TO BE CONFIRMED)% inclusive of VAT of the sale price achieved (e.g. if your property sells for the price of £(TO BE CONFIRMED), you will pay a fee of £(TO BE CONFIRMED) inclusive of VAT) (% plus VAT) and confirm that these fees are on a no sale no fee basis.  You will be liable to pay remuneration to us, in addition to any other costs or charges agreed, in each of the following circumstances:-
    • if unconditional contracts for the sale of the property are exchanged in the period during which we have sole/ joint/multi selling rights by a purchaser introduced by Stonegate Estates.
    • if unconditional contracts for the sale of the property are exchanged after the expiry of the period during which we have sole/joint/multi agency but to a purchaser who was introduced to you during that period or with whom we had negotiations about the property during that period.
  4. Stonegate Estates will be entitled to a commission fee if you terminate our instructions and a buyer that we have introduced goes on to exchange contracts on the property through another agent within 6 months of the date our instruction ended.
  • If no other estate agent is involved this time limit extends to 2 years.

 and that you may be liable to pay more than one fee if:

  • you have previously instructed another agent to sell the same property on a sole agency, joint sole agency or a sole selling rights basis; or
  • you instruct another agent during or after the period of our sole agency, joint sole or on a sole selling rights basis.
  1. In signing this agreement you are obliged to pay our fees arising from an exchange of contracts for the sale of your property and that you will authorise your solicitor or licensed conveyancer to pay our fees on completion out of the sales proceeds or to ensure that there are monies available upon completion to settle accordingly.
  2. Our fees cover local advertising and certain promotional charges (including For Sale boards, sales particulars, property guides, local advertising, internet and mailing).  If however you decide you require additional marketing then there will be a further charge which would be agreed by both parties and confirmed in writing.
  3. A sale board will be erected at your property as part of our marketing strategy.
  4. We must by law disclose to a prospective buyer any business or family relationship that you may have with Stonegate Estates or with any other company associated with us.
  5. If you sign our agency agreement during a visit by us to your home, place of work or away from our premises, then you have the right to cancel our contract within 14 days of signing. Should you wish to cancel your agreement please return the Notice of Right to Cancel within the time limit stated.
  6. We reserve the right to offer a full range of other services to prospective purchasers which include estate agents, financial services, removals, surveys and conveyancing from which we may derive other commissions or fees.
  7. We reserve the right to use sub agents to assist in the marketing of the property.  Signing this agreement gives us specific authorisation.
  8. By signing this agreement you confirm that if there is not a current Energy Performance Certificate (EPC), we have your authority to instruct our assessor to undertake this and you will pay his invoice directly.  The cost presently is £55 in total.
  9. The Agent will not be held responsible for any damage, however caused.  We recommend that you inspect the property periodically and that the water system be turned off and drained down, even in the summer.
  10. We are a member of The Property Ombudsman Scheme.
